The President of the United States is expected to serve the people and uphold the values enshrined in our Constitution. Donald Trump has repeatedly failed to do either.

Donald Trump has chosen to implement an agenda of chaos, destruction, and retribution. His actions are causing enormous panic and pain in people’s lives and having devastating impacts on our economy, democracy, freedoms, and the most vulnerable in our society.

I am listening closely to the many messages and phone calls I have received from constituents. I know that there is very real fear, anger, frustration, and uncertainty right now. I know people want answers and action, and I am committed to serving as a transparent and reliable leader for Ventura County and the Conejo Valley, and delivering for you and your family.

I have been working hard to oppose the dangerous actions of the Trump administration and to protect our democracy, our rights, and our communities. From co-signing legislation to limit Elon Musk’s access to sensitive data to speaking out on the House floor, I am determined to use every lever at Democrats’ disposal to stand up to Donald Trump and push back against this administration’s extreme overreach.

Donald Trump promised to lower prices on Day One. He lied.

More than a year into his second term, families are paying more for the essentials they need every day. Trump’s tariffs, his war in Iran, and the so-called “Big Beautiful Bill” are putting even more pressure on household budgets while handing tax breaks to billionaires and big corporations.

While Trump dismisses the housing crisis as “a big yawn” and says he wants to keep housing prices high, Democrats are fighting to build more housing, lower mortgage and rental costs, rein in corporate landlords, and make homeownership more attainable. While Republicans cut food assistance and health care to pay for tax breaks for the wealthy, Democrats are fighting to lower grocery and health care costs, protect coverage, and make caregiving more affordable for working families.

Donald Trump promised to lower prices on Day One. He lied.

More than a year into his second term, families are paying more for the essentials they need every day. Trump’s tariffs, his war in Iran, and the so-called “Big Beautiful Bill” are putting even more pressure on household budgets while handing tax breaks to billionaires and big corporations.

While Trump dismisses the housing crisis as “a big yawn” and says he wants to keep housing prices high, Democrats are fighting to build more housing, lower mortgage and rental costs, rein in corporate landlords, and make homeownership more attainable. While Republicans cut food assistance and health care to pay for tax breaks for the wealthy, Democrats are fighting to lower grocery and health care costs, protect coverage, and make caregiving more affordable for working families.

Families across Ventura County and the Conejo Valley are feeling the squeeze. Trump’s tariffs and Republicans’ economic agenda will only make it harder to pay the bills, save for the future, and get ahead.

How about you vote YES for the student loan interest rate cap of 2% to help Americans? If democrats would pass it — it would be a tremendous bipartisan bill and truly help Americans. That's not on Trump; that's more on Congress and states like CA. If anything, he has been a doorstop to most of the insanity of the Democratic Party.

I wonder if she understands that California, the state with the worst record in virtually EVERY category, has been under the control of her party for 16 years. Does she understand Californians pay the highest taxes in the country and get the least return on their investment? In California, we are currently building more than an additional 500 square miles of wind and solar farms while PAYING other states to take the excess power we generate between 10am and 3pm, the same time frame as PG&E is telling us to reduce usage; that's ironic, isn't it? Everyone complains about California's high gas taxes, but the isn't the problem. Restrictive laws on gas production, and its important by ocean freighters from China, are what is driving the cost of gas up. Did the IRAN WAR drive up gas prices? Yes. Before the war, California was paying about $2/gallon more for gas than the rest of the country. With the war, California still pays about $2/gallon more for gas than the rest of the country. California over-regulation adds up to $40K+ more to the cost to build the average house in California. When you go to the polls in November, remember that the Democrats have been in charge in California for 16 years. It's time for a change. Litigation

I am working closely with House Democratic leadership to support lawsuits against the Trump administration’s illegal and unconstitutional actions. Although Democrats in Congress are in the minority and don’t have the ability to directly file lawsuits and issue subpoenas, we are actively collecting information and data – including the impacts of the administration’s actions on constituents, nonprofits, local governments, and federal agencies – and coordinating on a litigation strategy against the Trump administration.

Below you will find a number of amicus briefs that I have filed alongside my fellow House Democrats to provide additional information, expertise, and arguments to the courts.

Amicus brief challenging the Trump administration’s unlawful freezing of congressional appropriated funds (New York v. Trump)

Congresswoman Brownley and 156 House Democrats filed an amicus brief in the case of New York v. Trump, before the U.S. Court of Appeals for the First Circuit, challenging the Office of Management and Budget’s unlawful freezing of congressional appropriated funds in order to further President Trump’s reckless agenda. The members argue that the President cannot unilaterally bypass Congress—and thereby the will of the American people—and withhold appropriated funds based on his own priorities or policy preferences. It also underscores that under the United States Constitution, Congress has the exclusive power to appropriate funds and to make laws governing their use. The unlawful freezing of more than $425 billion in congressionally authorized funding has not only trampled on the legislative process but has inflicted irreparable damage on communities across the country—blocking critical investments that families, businesses, and local governments rely on. Frozen funds include support allotted to local law enforcement, education programs, food assistance, broadband and power grid investments, emergency response and preparedness, science and research, and much more. Amicus brief challenging the Trump administration’s unprecedented DHS-IRS agreement that weaponizes and exposes confidential taxpayer data for immigration enforcement (Centro de Trabajadores Unidos vs. Bessent)

Congresswoman Brownley and 92 Congressional Democrats filed an amicus brief in the case of Centro de Trabajadores Unidos vs. Bessent, calling on the D.C. Circuit Court of Appeals to block an unprecedented agreement between the Department of Homeland Security (DHS) and the Internal Revenue Service (IRS) that allows immigration enforcement agents access to millions of taxpayers’ confidential IRS records. The Democrats submitted policy arguments demonstrating that this agreement contravenes Congress’s clear intent to protect taxpayer privacy and encourage all individuals present in the U.S. to pay taxes. The brief demonstrates that the harms of sharing taxpayer data far outweigh ICE’s interest in the information. The brief reinforces Congress’s long-standing, bipartisan intent to maintain a strict firewall between tax administration and immigration enforcement. It further explains how the District Court’s misinterpretation of 26 U.S.C. § 6103(i)(2) of the Internal Revenue Code gives the IRS greater leeway than is permitted by the statute to share taxpayer address information with Immigration and Customs Enforcement (ICE). It also emphasizes the importance of the Individual Taxpayer Identification Number (ITIN) program and taxpayer privacy protections under 26 U.S.C. § 6103 that enable individuals who are ineligible for Social Security Numbers to comply with federal tax law. It argues that the agreement stands to undermine both tax revenue – in 2022 alone, ITIN filers paid $59.4 billion in federal income taxes, plus billions more to Social Security and Medicare, despite being ineligible to receive those benefits – and taxpayer faith in the confidentiality of their tax data.

Amicus brief challenging Trump’s unlawful abuse of emergency powers to reimpose tariffs already struck down by the courts (Oregon, et al., v. Trump, et al.)

Congresswoman Brownley and 180 Members of Congress filed an amicus brief before the U.S. Court of Appeals (Oregon, et al., v. Trump, et al.) for the Federal Circuit challenging President Donald Trump’s sweeping and chaotic tariffs that were unlawfully imposed under the International Emergency Economic Powers Act (IEEPA). The lawmakers’ brief stands up for Congress’s Article I executive legislative powers and argues that IEEPA is not a tariff statute and that Congress did not intend or provide for IEEPA to be used as a tariff statute. In May, the Task Force successfully filed a brief in the same matter before the Court of International Trade (CIT). The CIT decision referenced our brief and struck down the President’s illegal tariffs under IEEPA. The administration has now appealed the lower court’s ruling, and the matter is now before the U.S. Court of Appeals for the Federal Circuit. The Constitution gives Congress, not the President, the authority to impose tariffs, and the President can only raise tariffs if Congress has clearly delegated its authority to him. Although IEEPA (enacted in 1977) grants the president authority to impose sanctions, block foreign assets, and regulate economic transactions in response to “unusual and extraordinary threats” originating abroad, it is not a tariff statute and has never been used that way. Congress knows how to delegate tariff authority and has clearly done so on a number of occasions. When Congress does delegate such authority, it imposes substantive, procedural, and temporal limits on the president’s power in order to avoid economic chaos and protect the American people.

Amicus brief opposing President Trump’s illegal attempt to dismantle the Department of Education and override Congress’s constitutional authority (NAACP v. US)

Congresswoman Brownley and 178 Members of Congress filed an amicus brief before the United States District Court for the District of Maryland (NAACP v. US) arguing that President Trump’s attempts to dismantle the Department of Education (ED) violate separation of powers and lack constitutional authority. The lawmakers wrote, “Since the Department was created, presidents have taken different views of the Department and the role the federal government should play in education policy, but none has attempted what President Trump is attempting here: to unilaterally shutter the department… In short, the ‘President’s power, if any, to issue an order’ abolishing the Education Department ‘must stem either from an act of Congress or from the Constitution itself.’ Here, President Trump’s effort to unilaterally dismantle the Education Department defies the express will of Congress. Defendants lack the power to do what only Congress can do—restructure the federal government by shuttering a government department.” On March 20, 2025, President Trump signed an executive order instructing Education Secretary Linda McMahon to “take all necessary steps” to abolish ED. This came after the Trump administration carried out a series of actions dismantling the Department, including mass firings of ED employees, the termination of contracts for congressionally authorized programs and activities, and the removal of crucial protections for student loan borrowers, while announcing plans to reorganize key ED functions into different departments. On March 24, 2025, a coalition of plaintiffs, including the National Association for the Advancement of Colored People (NAACP), the National Education Association (NEA), the American Federation of State, County, and Municipal Employees (AFSCME) Maryland Council 3, and others, filed a lawsuit to halt the Trump administration’s illegal efforts to dismantle ED. The lawsuit argues that dismantling a Congressionally created federal agency requires Congressional approval.

Amicus brief defending National Institutes of Health (NIH) Grants from the Trump administration’s unlawful cuts that threaten lifesaving medical research across the country (Commonwealth of Massachusetts v. NIH, Association of American Medical Colleges v. NIH, and Association of American Universities v. Department of Health and Human Services)

Congresswoman Brownley and 156 House Democrats filed an amicus brief challenging the Trump administration’s illegal and devastating cuts to life-saving medical research grants at the National Institutes of Health (NIH). The brief defends Congress’s Article I authority to appropriate federal funds and speaks up for every American who relies on crucial life-saving biomedical and public health research conducted at universities, medical schools, research hospitals, and other scientific institutions across the country. House Democrats’ amicus brief was filed in the consolidated cases Commonwealth of Massachusetts v. NIH, Association of American Medical Colleges v. NIH, and Association of American Universities v. Department of Health and Human Services, all currently before the U.S. Court of Appeals for the First Circuit. These cases challenge the Trump administration’s unlawful and unconstitutional efforts to reduce indirect cost reimbursements for projects funded by the NIH. In early February, the Trump administration arbitrarily slashed the NIH reimbursement rate for indirect research costs. Without fair reimbursement for indirect costs, more than 300,000 scientists and researchers at 2,500 institutions that receive NIH funding will face devastating impacts, and Americans could be left without access to lifesaving and life-extending treatments. The ramifications would also ripple through global collaboration and the development of our future scientific leadership and workforce, limiting our ability to enhance health and reduce illness and disability in the future.

Amicus brief further escalating fight against the Trump administration’s illegal attacks on the constitutional principle of birthright citizenship (Trump v. Casa, Inc.)

Congresswoman Brownley and 169 House Democrats filed an amicus brief in the matter of Trump v. Casa, Inc., which is now before the 4th Circuit Court of Appeals. The Members remain steadfast in their commitment to fighting the Trump administration’s illegal attacks on the constitutional principle of birthright citizenship. The Trump administration filed this appeal to overturn a nationwide preliminary injunction blocking the President’s attempt to change the constitutional right to birthright citizenship via executive order. The amicus brief provides overwhelming evidence that President Trump’s Executive Order violates the Constitution and over a century of Supreme Court rulings, as well as laws enacted by Congress. It also signifies the lawmakers’ commitment to defending birthright citizenship, following their amicus briefs filed in State of Washington v. Trump before the Ninth Circuit Court of Appeals, and in the Supreme Court cases Trump v. Washington, Trump v. CASA, Inc., and Trump v. New Jersey.

Amicus brief challenging Trump’s reckless abuse of emergency powers to unilaterally impose chaotic, unlawful tariffs and bypass Congress’s constitutional authority (Oregon, et al., v. Trump, et al.)

Congresswoman Brownley and 147 Members of Congress filed an amicus brief challenging President Donald Trump’s sweeping and chaotic tariffs unlawfully imposed under the International Emergency Economic Powers Act (IEEPA). The lawmakers’ brief stands up for Congress’s Article I exclusive legislative power to impose tariffs and regulate commerce, and argues that IEEPA does not give the President the power to impose reckless, on-again-off-again tariffs, which have wreaked havoc on the U.S. economy. It was filed in the matter of Oregon, et al., v. Trump, et al., which was brought forth by 12 States’ Attorneys General. The Constitution gives Congress, not the President, the authority to impose tariffs, and the President can only raise tariffs if Congress has clearly delegated its authority to him. Although IEEPA (enacted in 1977) grants the president authority to impose sanctions, block foreign assets, and regulate economic transactions in response to “unusual and extraordinary threats” originating abroad, it is not a tariff statute and has never been used that way. On May 28, the three-judge panel of the U.S. Court of International Trade unanimously blocked President Donald Trump’s effort to impose sweeping and chaotic tariffs under the International Emergency Economic Powers Act (IEEPA). In their ruling, the judges, appointed to the federal bench by Presidents Reagan, Obama, and Trump, adopted the arguments House Democrats made in their amicus brief in the case: the emergency powers granted to the President by Congress in IEEPA do not include the authority to impose tariffs.

Amicus brief defending consumers and the Consumer Financial Protection Bureau (CFPB) from Trump-Musk assault & illegal power grab (National Treasury Employees Union (NTEU), et al. v. CFPB Acting Director Russell Vought, et al.)

Congresswoman Brownley and 233 current and former Members of Congress filed an amicus brief in defense of the Consumer Financial Protection Bureau (CFPB). The brief was submitted in the case of National Treasury Employees Union (NTEU), et al. v. CFPB Acting Director Russell Vought, et al. before the U.S. Court of Appeals for the D.C. Circuit following an appeal by the Trump administration of a D.C. District Court ruling that blocked the administration’s unlawful shutdown. As emphasized in the brief, Congress established the CFPB following the devastating 2008 global financial crisis that “shattered” lives, “shuttered” businesses, and “evaporated” savings. This agency was created to hold accountable the big banks and predatory lenders whose unfair and deceptive practices caused the crisis. While Trump and Musk have made several unlawful attempts to abolish the CFPB without Congressional approval, the Members make clear in the brief that the sole authority to do so lies with Congress, as Congress created the agency. This Constitutional power holds true regardless of any President’s personal views about the agency. Moreover, in the past, when Congress determined to give the President reorganization authority, it did so through legislation. The President has no authority to prevent the agency from fulfilling its statutory mission to protect consumers from harmful practices of the financial services industry. In fact, since the agency was established 15 years ago, it has returned $21 billion to 205 consumers, including working-class families, servicemembers, veterans, students, and others harmed by predatory institutions. Gutting this agency would halt this work, as no alternative agency has the authority and resources to fill this massive void.

Amicus brief elevating fight against Trump administration’s illegal attacks on the constitutional principle of birthright citizenship (Trump v. State of Washington, Trump v. CASA, Inc., and Trump v. State of New Jersey)

Congresswoman Brownley and 182 House Democrats filed an amicus brief for the three birthright citizenship cases currently before the United States Supreme Court (Trump v. State of Washington, Trump v. CASA, Inc., and Trump v. State of New Jersey), elevating their fight against the Trump administration’s illegal attacks on the constitutional principle of birthright citizenship to the highest court in the land. The brief offers a compelling argument that President Trump’s week one order to strip the guarantee of citizenship provided to children born in America violates the Constitution and over a century of Supreme Court rulings, and laws enacted by Congress. The justices are set to hear oral arguments in the cases on May 15th, following the administration’s request that they lift a nationwide pause currently halting the implementation of this policy.

Amicus brief challenging Trump administration’s efforts to close the Department of Education (State of New York v. Linda McMahon)

On April 23rd, Congresswoman Brownley and 191 House Democrats filed an amicus brief challenging the Trump administration’s efforts to close the Department of Education in the matter of the State of New York v. Linda McMahon – a case in which 20 states moved to sue the administration for its plans to place fifty percent of the Department’s workforce on administrative leave, effectively shuttering a congressionally authorized agency by way of executive fiat. By involving themselves in this legal battle, House Democrats sought to stand up for Congress’s power to ensure a quality education for all Americans—and in their filing, they argued that the Trump administration cannot unilaterally create, dismantle, or reorganize the Education Department, nor can executive officials make solitary decisions regarding the agency’s organization and assignment of functions. The lawmakers also cited executive overreach, noting that efforts to strip support for the federal agency violate Congress’s power of the purse.

Amicus brief opposing President Donald Trump’s unlawful attempt to fire members of the Federal Trade Commission (FTC)

On April 14th, Congresswoman Brownley, 209 House Democrats, and 41 Senators filed an amicus brief opposing President Donald Trump’s unlawful attempt to fire members of the Federal Trade Commission (FTC). FTC Commissioners Rebecca Slaughter and Alvaro Bedoya are duly appointed, Senate-confirmed Commissioners at an independent federal agency created by Congress. Trump’s illegal attempts to terminate them threaten the integrity of independent federal agencies and the FTC’s ability to enforce civil antitrust law and protect the public from fraudsters and monopolists. In Slaughter v. Trump, a case filed in the U.S. District Court for the District of Columbia challenging the unlawful attempted firings of FTC Commissioners Slaughter and Bedoya, the congressional amicus brief argues: 1) The Supreme Court’s 1935 decision in Humphrey’s Executor makes clear that Congress has the power to create independent multimember agencies like the FTC and provide removal protections for FTC Commissioners; 2) Throughout our nation’s history, Congress has created independent agencies with multimember boards or commissions whose members enjoy removal protections, like the Commissioners of the FTC, and this established practice has been consistently upheld by the Supreme Court; and 3) Constitutional text and history support Congress’ constitutional authority to temper the President’s exercise of removal.

Amicus Brief in defense of essential constitutional principle of birthright citizenship, pushing back against President Trump’s unlawful executive directives (State of Washington, et al. v. Trump, et al.)

On April 12th, Congresswoman Brownley and 207 members of the Democratic Caucus filed an amicus brief in defense of the essential constitutional principle of birthright citizenship in the matter of State of Washington, et al. v. Trump, et al. pushing back against President Donald Trump’s unlawful executive directives. In their argument, the amici curiae (or friends of the court) presented overwhelming evidence that Trump’s day-one order to nullify birthright citizenship violates not just the Constitution and over a century of Supreme Court rulings, but also laws passed by Congress that have repeatedly guaranteed citizenship to children born in America.

Amicus Brief opposing President Donald Trump’s unlawful attempts to fire members of the National Labor Relations Board (NLRB) and the Merit Systems Protection Board (MSPB) (Cathy Harris v. Scott Bessent, et al. and Wilcox v. Trump et al.)

On April 9th, Congresswoman Brownley, 211 House Democrats, and 41 Senators filed an amicus brief for two cases (Cathy Harris v. Scott Bessent, et al. and Wilcox v. Trump et al.) opposing President Donald Trump’s unlawful attempts to fire members of the National Labor Relations Board (NLRB) and the Merit Systems Protection Board (MSPB). The individuals cited in this matter were duly appointed, congressionally confirmed board members at independent federal agencies. Illegal attempts to terminate them threaten the integrity of these institutions and their ability to protect American workers and uphold workplace democracy. The NLRB and MSPB play a critical role in protecting workers, both in public service and the private sector, in their right to seek better working conditions and in safeguarding a non-political, merit-based federal workforce.

Amicus brief standing up to President Trump’s blatant executive overreach and illegal dismantling of the United States Agency for International Development (USAID) (American Foreign Service Association, et al. v. Trump, et al.)

On March 31st, Congresswoman Brownley and 201 House Democrats filed an amicus brief standing up to the blatant executive overreach and illegal dismantling of the United States Agency for International Development (USAID), in the matter of American Foreign Service Association, et al. v. Trump, et al. In their brief, the members argued that the President’s directive blatantly violated Congress’s lawmaking and spending powers as explicitly outlined in Article I of the United States Constitution, by dismantling a federal agency authorized and repeatedly funded by acts of Congress. The shuttering of USAID, including placing thousands of workers on leave and halting nearly all congressionally approved foreign aid, undermines a critical component of the federal government responsible for global stability and American security. For nearly 40 years, USAID has played a central role in preventing crises, fostering economic opportunities abroad, and mitigating the conditions that contribute to violent extremism and instability. Scaling back its work not only weakens these efforts but also creates a vacuum for global competitors like China, Russia, and Iran to expand their influence.

Amicus brief in defense of American consumers and the Consumer Financial Protection Bureau (CFPB), pushing back against President Trump’s unlawful attempts to shut down agency that protects Americans from unfair, deceptive, and abusive corporate practices (National Treasury Employees Union (NTEU), et al. v. CFPB Acting Director Russell Vought, et al.)

On February 28, Congresswoman Brownley and 197 House Democrats filed an amicus brief in defense of American consumers and the Consumer Financial Protection Bureau (CFPB) in the matter of National Treasury Employees Union (NTEU), et al. v. CFPB Acting Director Russell Vought, et al. before the U.S. District Court for the District of Columbia. As the House members described in their amicus brief, President Trump has already imposed significant and irreparable harm on consumers across the country. In seeking to “shut down” CFPB, President Trump wants to eliminate the agency that protects Americans from unfair, deceptive, and abusive corporate practices, giving even more power to his corrupt billionaire friends serving as top advisors. In the brief, the House Democratic leaders noted that recent actions toward the CFPB, the “consumer watchdog agency,” including the implementation of sweeping stop-work orders and plans to arbitrarily fire most employees, represent a blatant disregard for Congress’s role and express directives. These actions are in clear violation of the Dodd-Frank Wall Street Reform and Consumer Protection Act of 2010, as well as the Constitution’s mandate that the laws be faithfully executed. As the CFPB is the only federal agency dedicated solely to protecting American consumers in the financial marketplace, the lawmakers also underscored the threat to key operations that provide relief from a wide range of unlawful practices costing hardworking families billions. These include rulings promoting small business lending transparency, curbing excessive overdraft fees, and preventing medical debt from limiting creditworthy borrowers’ access to credit. Congresswoman Brownley and 39 Members of Congress submitted an amicus brief to the United States Court of Appeals for the District of Columbia in the case of Climate United Fund, et al. v. Citibank, N.A. et al, urging the reinstatement of Greenhouse Gas Reduction Fund (GGRF) grants. The lawmakers pressed the Court to grant a rehearing en banc, or hearing of the full active bench, and to overturn the erroneous ruling issued earlier this month by a three-judge panel of the Court. That poorly reasoned ruling allows the Environmental Protection Agency (EPA) to proceed with its efforts to illegally claw back GGRF awards that were appropriated by Congress and fully disbursed into private bank accounts. The GGRF is a $27 billion national climate financing network that facilitates investments in affordable clean energy deployment to spur economic development, lower energy costs, and reduce pollution.

Congresswoman Brownley and 124 Members of Congress submitted an amicus brief to the U.S. Court of Appeals for the Ninth Circuit in the case of National TPS Alliance et al. v. Noem, urging the reversal of the Trump Administration’s baseless decision to vacate and terminate the Temporary Protected Status (TPS) designation for Venezuela. First granted for Venezuela in 2021, TPS has provided approximately 600,000 Venezuelans in the U.S. refuge from economic turmoil and humanitarian crisis in their home country, and authorization to live and work legally in America. A District Court ruled in September that the Trump Administration’s decision to vacate and terminate Venezuela’s TPS designation was unlawful. After the Trump Administration appealed the decision to the Supreme Court to request a stay of that ruling, Representative Brownley and her colleagues filed an amicus brief calling for the District Court decision to be upheld. The Supreme Court later sided with the Administration – allowing the Department of Homeland Security to continue stripping Venezuelans of their protections to remain lawfully in the U.S. while the case is fully considered in the Ninth Circuit.

Trump, et al.)

Congresswoman Brownley and 206 Members of Congress took their fight against President Donald Trump’s sweeping and chaotic on-again-off-again tariffs to the highest court in the land, filing an amicus brief before the United States Supreme Court. The lawmakers’ filing stands up for Congress’s Article I legislative powers and argues that the IEEPA is not a tariff statute and that Congress did not intend or provide for the IEEPA to be used as a tariff statute. The Constitution gives Congress, not the President, the authority to impose tariffs, and the President can only raise tariffs if Congress has clearly delegated its authority to him. Although IEEPA (enacted in 1977) grants the president authority to impose sanctions, block foreign assets, and regulate economic transactions in response to “unusual and extraordinary threats” originating abroad, it is not a tariff statute and has never been used that way. Notwithstanding law and precedent, on April 2, 2025, now dubbed by the Trump administration as “Liberation Day,” President Trump invoked the IEEPA to authorize a sweeping set of tariffs on foreign imports. 12 States’ Attorneys General quickly sued the administration for this action (Oregon, et al., v. Trump, et al.)

Congresswoman Brownley and 154 Members of Congress, in support of Illinois’s legal challenge to President Trump’s unwarranted National Guard deployment in Illinois, Filing an amicus brief to the Supreme Court in Trump v. Illinois. In October 2025, following comments from President Donald Trump that his administration needed to “solve the crime problem fast” in Chicago, the administration deployed hundreds of National Guard troops in the Chicago area. The State of Illinois and the City of Chicago went to court to challenge this use of the National Guard, and a federal district court granted an injunction blocking it, which the administration appealed to the Seventh Circuit. The administration also sought a stay of the district court’s order pending appeal. The Seventh Circuit denied the administration’s motion for a stay, leaving in place the order that prevents troops from deploying in Chicago. Shortly after the panel decision, the Trump administration asked the Supreme Court to step in and stay the order of the district court. In December 2025, the Supreme Court denied the Trump’s application for a stay, he Trump administration announced it would remove the National Guard from Chicago, and in January 2026, the parties agreed to dismiss the Seventh Circuit appeal.

Congresswoman Brownley and 90 House Democrats opposed the Trump Administration’s lawless effort to eliminate the Department of Justice’s (DOJ) Community Relations Service (CRS). House Democrats stood up for Congress’s Article I power to create vital programs like CRS, which was established as part of the Civil Rights Act of 1964 to help communities across the country resolve conflict and violence. For over sixty years, CRS has served as “America’s Peacemaker”—deploying conciliators to Selma after Bloody Sunday, de-escalating tensions around the Nazi march in Skokie, and helping communities heal after attacks on houses of worship and hate crimes. Congress has repeatedly affirmed and extended CRS’s statutory mission with broad bipartisan support, but the Trump Administration is now trying to decimate the CRS. The Administration’s dismantling of the peace-preserving agency comes as the nation faces a sharp rise in hate crimes, antisemitic attacks, and political violence.

Amicus brief in defense of the Consumer Financial Protection Bureau (CFPB), which was established in the aftermath of the 2008 financial crisis, following an appeal by the Trump Administration of a D.C. District Court ruling that blocked a series of actions taken by Donald Trump to unilaterally dismantle the Consumer Bureau, as the sole authority to do so lies with Congress, as Congress created the agency (National Treasury Employees Union (NTEU), et al. v. CFPB Acting Director Russell Vought, et al.)

Congresswoman Brownley and 237 current and former Members of Congress filed an amicus brief in defense of the Consumer Financial Protection Bureau (CFPB) against the Bureau’s Trump-Musk assault. Following the devastating 2008 global financial crisis that “shattered” lives, “shuttered” businesses, and “evaporated” savings, this agency was created to hold accountable the big banks and predatory lenders whose unfair and deceptive practices caused the crisis. In early 2025, following a change in presidential administration, the new Acting Directors, first Scott Bessent and then Russell Vought, implemented measures to significantly downsize the CFPB, including pausing most agency activities, terminating employees, canceling contracts, declining additional funding, moving to smaller headquarters, and requiring advance approval for agency work. Several plaintiffs, including organizations representing CFPB employees and groups that use CFPB services, filed suit in the United States District Court for the District of Columbia. They alleged that the agency’s actions amounted to an unlawful attempt to “shut down” the CFPB, violating both statutory mandates and the separation of powers. The court concluded that the plaintiffs’ attempt to challenge an inferred, overarching decision to shut down the CFPB was not viable under the APA or in equity. Accordingly, the D.C. Circuit vacated the preliminary injunction and remanded the case.

The lawmakers pressed the Court to vacate EPA’s illegal termination of the program’s funding, which was a clear attempt to “evade its statutory obligations [and] aggrandize[e] executive power at the expense of settled legislative prerogatives.” GGRF, a $27 billion national climate financing fund passed into law as part of the Inflation Reduction Act, has been a frequent target of the Trump Administration’s war on climate safety and low-cost clean energy. EPA has attempted to argue that the only way it could restore funding would be to issue replacement grants. The Democratic lawmakers argue that President Donald Trump’s day-one executive order to strip the guarantee of citizenship provided to children born in America violates the Constitution and over a century of Supreme Court rulings, as well as laws enacted by the Congress. As the Trump’s immigration policy continues to inflict chaos across the country, lawmakers affirmed that the Fourteenth Amendment provides Congress with authority to enforce the constitutional guarantee of birthright citizenship. They also argued that the administration’s interpretation of birthright citizenship is legally incoherent, outlining how the order would affect the children of asylum seekers and warning that 1.8 million U.S. citizens born to two unauthorized parents could be at risk of retroactively losing their citizenship. The lawmakers concluded by criticizing the administration for unilaterally disregarding the nation’s immigration and naturalization laws, particularly the Immigration and Nationality Act of 1952 (the “INA”).

Congresswoman Brownley and more than 250 Members of Congress filed an amicus brief to the U.S. Supreme Court in State of Louisiana v. U.S. Food and Drug Administration (FDA), a case that could have sweeping implications for access to medication abortion nationwide. Louisiana v. FDA stems from ongoing legal challenges by anti-abortion politicians and advocates seeking to restrict access to medication abortion. On May 1, the Fifth Circuit Court of Appeals granted Louisiana’s request for a nationwide judgment requiring patients to fill mifepristone prescriptions in person at a health center, effectively ending access via telehealth, mail order, and pharmacy. On May 4, the Supreme Court granted an administrative stay in Louisiana v. FDA. This restores access to mifepristone via telehealth, mail order, and pharmacies for one week while the case proceeds on emergency docket. Congressional Democrats argue in their amicus brief that allowing courts to override FDA determinations undermines the agency’s authority as established by Congress and threatens the integrity of the nation’s drug approval process.

Ultimately, the lawmakers urged Judge Williams to dismiss the lawsuit for lack of jurisdiction.

Congresswoman Brownley and 163 Members of Congress filed an amicus brief in federal court to stop President Trump’s illegal demolition and reconstruction of the White House East Wing to build a billion-dollar ballroom for his billionaire friends and donors. The lawmakers filed the amicus brief in the case National Trust for Historic Preservation v. National Park Service, currently pending before the U.S. Court of Appeals for the D.C. Circuit, challenging President Trump’s demolition of the White House East Wing without congressional authorization or appropriation. Congress controls federal property, including the White House, and for more than two centuries every major renovation has gone through congressional authorization and appropriation. Trump bypassed Congress entirely, and no law authorizes what he is doing.

Congresswoman Brownley and 113 Members of Congress filed an amicus brief in District of Columbia v. Trump, a D.C. Circuit case evaluating President Trump’s deployment of National Guard troops to the District of Columbia. Representative Brownley and her colleagues argue that the Court should affirm the district court’s holding that the president had no legal authority to deploy the National Guard to DC, as President Trump’s deployment of the National Guard in Washington, D.C., is dangerous executive overreach that tramples on the  District of Columbia’s right to self-governance provided by Congress. Using federal troops to intimidate everyday Americans and override the District’s elected officials undermines this self-governance and ignores the limits Congress very intentionally placed on presidential authority.
